RE: The tariff classification of a child’s knit top from China.

Dear Ms. Harris:

In your letter dated August 15, 2011, you requested a tariff classification ruling. The sample will be retained by this office.

The submitted sample, “tu-tu cute” is a craft kit for a child’s tube top constructed from 95% polyester, 5% spandex crocheted fabric and lined with polyester knit fabric. The item is sold unassembled in kit form together with approximately 40 strips of knitted tulle fabric that that are 20 inches long by 6 inches wide and that are designed to be threaded through the loops at the base of the tube top and folded over to form fabric extensions. The article is designed to be worn over leggings. The kit is sold in the craft department of variety stores and will be purchased by adults who will assemble the item for a child.

The applicable subheading for the “tu-tu cute” will be 6114.30.1020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted or crocheted: of man-made fibers: tops, women’s or girls’. The rate of duty will be 28.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
